NEW TIME FRAME FOR LISTING INPUT & LISTING
UPDATES TO BECOME EFFECTIVE ON JANUARY 1, 2023

Beginning January 1st, the timeline for submittal of all new listings, status changes, and any changes germane to the listing agreement will be required to occur within one (1) business day from the start date of the listing, or the date of the Seller’s signature, whichever is last. This is a reduction from the previous policy of 3 business days. Required docs are to be uploaded by the Listing Agent into Paragon’s associated docs within this same time frame, including Seller authorized change forms.

A Seller’s Property Condition Disclosure will still be required to be uploaded into Paragon within 24 hours from the date an MLS number was assigned to the listing in Paragon.

When inputting a new listing, the date to place in the field for Listing Date is the start date on the listing agreement, or the date of the Seller’s signature, whichever is last.

FINE ESCALATIONS FOR REPEAT MLS VIOLATIONS WILL BE ASSESSED AFTER JANUARY 1st

A policy has been established to increase the fine amount for repeat MLS violations within a rolling 12-month time period specific to the timely submittal in Paragon for new listings, status changes, and any changes germane to the listing agreement:

  • A first Listing Violation is $50. A first Status Change Violation is $100.
  • A second Listing Violation escalates to $100 with required MLS training. A second Status Change Violation escalates to $250 with required MLS training.
  • A third Listing Violation is $250 and permissions reduced to Level 3 for 5 completed transactions. A third Status Change Violation is $500 and permissions reduced to Level 3 for 5 completed transactions.
  • A fourth Listing Violation or Status Chane Violation will be taken before the Professional Standards Committee for review and disciplinary action.

NEW IMPLEMENTATION OF FINES TO LISTING AGENTS WHEN A LISTING IS NOT FAIRLY AND EQUALLY ACCESSIBLE TO ALL IN THE LAWRENCE MLS

Beginning January 1st, the MLS may fine a listing agent when a listing with visibility status of MLS Listing, is not fairly and equally accessible to all members of the Lawrence MLS. Violations will be reported on a complaint basis. Instances in which a member of the Lawrence MLS was not provided fair and equal access are to be reported to Lawrence MLS Staff.

  • A First Offense is $500 with required MLS training.
  • All further offenses will be referred to the Professional Standards Committee.

NEW ADDITION TO THE EXCLUSIVE RIGHT OF SALE - LISTING AGREEMENT (to be released soon - January 2023)

The Seller’s Authorization to Withhold section of the Exclusive Right of Sale (Listing Agreement) will now include checkboxes with explanations for Limited Visibility Types in Paragon. A Broker’s signature will now be required for any listing in which the Agent Exclusive Limited Visibility Type is selected. Continue to use the existing agreement until notice of the new agreement is delivered to Brokers, and then Agents.

NEW SOLD STATUSES FOR SALES WITH A LIMITED VISIBILITY TYPE AT THE TIME OF CONTRACT

Three new SOLD statuses for closings in which there was an existing Limited Visibility Type at the time of Contract: SOLD Agent-Exclusive, SOLD Office-Exclusive, SOLD Firm-Exclusive.

NEW MLS POLICY HAS BEEN ESTABLISHED FOR MLS VIOLATIONS LEFT INCOMPLETE OR UNDONE

An additional per diem of $10 will accrue for each day the listing agent does not correct the violation, provided that 1 full business day of notice is allowed for the listing agent/office to correct the violation (this typically will apply to an incomplete listing or a listing that is missing documentation).
